沒有有效中國工作類、私人事務類和團聚類居留許可的外國人能否入境中國？

眾所周知，中華人民共和國外交部國家移民管理局于2020年9月23日發布了一條重磅消息：

As we all know, the state immigration administration of the Ministry of foreign affairs of the People's Republic of China issued a heavy message on September 23, 2020.

自2020年9月28日0時起，允許持有效中國工作類、私人事務類和團聚類居留許可的外國人入境，相關人員無需重新申辦簽證。如外國人持有的上述三類居留許可于2020年3月28日0時后過期，持有人在來華事由不變的情況下，可憑過期居留許可和有關材料向中國駐外使領館申辦相應簽證入境。上述人員需嚴格遵守中方防疫管理規定。

3月26日公告其他措施繼續實施。中方將在確保防疫安全前提下，逐步有序恢復中外人員往來。

Effective from 0 a.m., 28 September 2020, foreign nationals holding valid Chinese residence permits for work, personal matters and reunion are allowed to enter China with no need for applying for new visas. If the above three categories of residence permits held by foreign nationals expired after 0 a.m., 28 March 2020, the holders may apply for relevant visas by presenting the expired residence permits and relevant materials to the Chinese embassies or consulates on the condition that the purpose of the holders’visit to China remains unchanged. The above-mentioned personnel shall strictly abide by the Chinese regulations on epidemic prevention and control.

Other measures in the Announcement issued on March 26 will continue to be implemented. While ensuring effective epidemic control, the Chinese government will continue resuming people-to-people exchanges in a step-by-step and orderly manner.

簡言之，就是根據9月23日公告內容，外國人想要入境中國：

In short, according to the announcement on September 23, foreigners want to enter China:

1. 9月28日0時起，持有在有效期內的工作類、私人事務類和團聚類這三種居留許可的外國人，可持有效居留許可入境中國。

From 0 a.m., 28 September 2020, foreign nationals holding valid Chinese residence permits for work, personal matters and reunion are allowed to enter China directly.

2. 如現有工作類、私人事務類和團聚類居留許可是在2020年3月28日0時后過期的，在入境事由不變情況下，可憑過期的居留許可和有關材料到中國駐外使領館申辦對應種類簽證入境。（上述所提到的有關材料是哪些材料，請與當地使領館咨詢確認）

If the above three categories of residence permits held by foreign nationals expired after 0 a.m., 28 March 2020, the holders may apply for relevant visas by presenting the expired residence permits and relevant materials to the Chinese embassies or consulates on the condition that the purpose of the holders’visit to China remains unchanged. (please contact the local embassy or consulate for confirmation of the materials mentioned above.)

3. 僅持有簽證（2020年3月26日0時前簽發），或者雖持有有效居留許可但不是工作類、私人事務類和團聚類居留許可的，均不屬于9月23日公告調整范圍，暫不能入境。

Those who only hold a visa (issued before 0:00 on March 26, 2020), or those who hold valid residence permit but are not for work, personal matters and reunion are not included in the adjustment scope announced on September 23, can't enter yet.

那么，沒有上述所說的三類有效居留許可的外國人是否也能入境中國呢？

So, can foreigners who do not have the above three kinds of valid residence permits be allowed to enter China?

答案是肯定的，但是需要來華邀請函。

The answer is yes, but need invitation letter(PU letter).

政策解讀：

通過解讀3月26日的公告和9月23日的公告，我們能發現，持外交、公務、禮遇、C字簽證入境不受影響。外國人如來華從事必要的經貿、科技等活動，以及出于緊急人道主義需要，可向中國駐外使領館申辦簽證。外國人持公告后簽發的簽證入境不受影響。

Through the interpretation of the announcement on March 26 and the announcement on September 23, we can find that entry with diplomatic, official, courtesy and C visa will not be affected. Foreigners who come to China to engage in necessary economic, trade, scientific and technological activities, and for urgent humanitarian needs, may apply for a visa from Chinese embassies and consulates abroad. Entry of foreigners with a visa issued after the announcement will not be affected.

而且為了響應3月26日由國家移民局發布的《關于暫時停止持有效中國簽證、居留許可的外國人入境的公告》中提到的“外國人如來華從事必要的經貿、科技等活動，以及出于緊急人道主義需要，可向中國駐外使領館申辦簽證”。 根據上級有關文件精神，為確保我省復工復產需要，外籍經貿、科技類必要的人士可經由所在地外事（商務）部門向省外辦（商務廳）申請辦理來華邀請函。

Moreover, in response to the announcement on temporary suspension of entry of foreigners holding valid Chinese visa and residence permit issued by the state immigration administration on March 26, it was mentioned that "foreigners who come to China to engage in necessary economic and trade, scientific and technological activities, and for urgent humanitarian needs, may apply for a visa from Chinese embassies and consulates abroad". According to the spirit of the relevant documents of the higher authorities, in order to ensure the need for the resumption of work and production in our province, foreign economic, trade and scientific and technological personnel may apply to the Provincial Foreign Affairs Office (Department of Commerce) for invitation letters to China through the local foreign affairs (Commerce) department.

而隨著疫情形勢的變化，中國正逐漸放寬外國人入境限制。先是今年8月，中國對歐洲36個國家持中國有效居留許可的公民放寬入境限制，允許他們免邀請函申辦赴華簽證。

With the change of the epidemic situation, China is gradually relaxing the entry restrictions for foreigners. First, in August this year, China relaxed entry restrictions on citizens of 36 European countries with valid Chinese residence permits, allowing them to apply for visa applications in China without invitation letter.
